Asylum
Asylum is a form of protection offered by the United States. It allows foreign nationals to remain in the U.S. after escaping their home countries where they were subject to persecution or harm.
Foreign nationals seeking asylum must be physically present in the United States. They must submit an application to U.S. Citizen and Immigration Services (USCIS) explaining that they have experienced persecution or fear persecution based on their race, religion, nationality, membership in a particular social group, and/or political opinion. A person who is granted asylum is called an asylee.
A person can apply for asylum by submitting either an affirmative or defensive Form I-589, Application for Asylum and for Withholding of Removal. An affirmative asylum application is the process of filing a Form I-589 with all your evidence directly with USCIS. However, if in removal proceedings, the applicant files a defensive asylum with the Department of Justice’s Executive Office for Immigration Review (EOIR) to the Immigration Judge.
